Legal Actions Over Holiday Collisions Can Last Well Into the New Year

Most people who make New Year’s resolutions give them up quickly; the gym equipment that people buy from Amazon on January 1 barely gets a single use, if it even gets used at all. Meanwhile, at the beginning of every year, the Internet is abuzz about Divorce Monday, when people who reached their wits’ end with their spouses and in-laws during the holidays file for divorce or contact divorce lawyers. It is safe to assume that not every contact form filled out on a family law firm’s website translates into a divorce, so many of the people who were unhappily married on the Sunday before Divorce Monday are still unhappily married on the following New Year’s Eve, and there are probably even a few of us hopeless romantics out there who still believe that some people are on better terms with their spouses in December than they were in January, when holiday stress made them contemplate divorce.

Albuquerque Man Gets Charges for DWI Homicide After Causing New Year’s Eve Accident

At about 8:30 in the evening on December 31, 2025, a white Lincoln was trying to make a left turn onto Indian School Road in Albuquerque. A U-Haul truck was passing by, making it hard for the driver to see oncoming traffic. Despite this, cars approaching on Indian School would have been able to avoid a collision if they had been driving at a safe speed and using reasonable caution. A silver Honda that was behind the U-Haul on Indian School was speeding, though, and it collided with the Lincoln. The driver of the Lincoln was injured, and the passenger died.

Police who responded to the accident noticed that the driver of the Honda, a 24-year-old man, seemed to be under the influence of alcohol. The ABQ Journal news website did not say what his blood alcohol content (BAC) was at the time of the accident, or even whether police took a breath sample at the scene. The driver is now facing criminal charges for vehicular homicide and DWI.
